What This Guide Covers

What makes a passenger-carrying operation a regulated commercial motor vehicle under FMCSA, and the operating-authority and insurance requirements that follow — at the administrative level, not vehicle engineering or route planning.

02

How This Area Fits Your Operation

A vehicle is a commercial motor vehicle if it's designed or used to transport more than 8 passengers (including the driver) for compensation, or more than 15 passengers regardless of compensation. FMCSA's own guidance is explicit that once a carrier is for-hire and in interstate commerce, vehicle size or passenger count does not change whether operating-authority regulation applies — a small-vehicle shuttle operation is not automatically exempt. Minimum insurance requirements scale with seating capacity: $5,000,000 for vehicles seating 16 or more (including the driver), $1,500,000 for 15 or fewer.

03

Records To Organize

  • For-hire passenger operating authority (filed on FMCSA Form OP-1(P), distinct from the property-carrier form)
  • Proof of minimum insurance — $5,000,000 for vehicles seating 16 or more (including the driver), $1,500,000 for 15 or fewer
  • Process agent designation
  • CDL and endorsement records for drivers of vehicles seating 16 or more, or otherwise meeting CDL thresholds
04

Dates That May Require Attention

  • New entrant monitoring period: 18 months from the start of operations, with a safety audit generally once sufficient operating records exist (at least 3 months in, per the current regulation text)

How DOT Serenity Fits

This area is in development. Today, DOT Serenity organizes general company, driver and vehicle records that also apply to a passenger operation — it does not yet have dedicated recordkeeping for passenger-carrier-specific requirements like operating-authority class or insurance-minimum tracking.
